The Sense:buds Consumer Community is subsidiary of Blue Yonder Research Ltd.

By registering as a member of the Sense:buds Consumer Community, you are agreeing to these Terms of Use and Membership.

Membership

Membership of the Sense:buds Consumer Community is restricted to UK residents aged 16 or over. You are permitted to have only one account. Participation in certain studies may be further restricted based on your age, gender or geographic location.

By becoming a member of the Sense:buds Consumer Community, you are agreeing to being contacted by Sense:buds Consumer Community to participate in legitimate market research projects. Contact may be by email, phone, SMS or post. Please note, when we contact you by phone, our calls are being recorded for training and quality purposes.

Registration

In order to create an account, you must provide Sense:buds Consumer Community with complete and valid contact information including: Full legal name, home address, gender, date of birth, at least one valid UK telephone number and a valid email address owned by yourself.

By joining the Sense:buds Consumer Community you agree to provide only accurate, current and complete registration information and to update that information when requested.

Cancellation of Membership

You have the right to cancel your account at any time. This can be done at any time in the Member Dashboard. Please ensure that you do not have credit pending as your account data will be deleted, and you will not be able to access your outstanding funds.

Member Conduct

When participating in studies conducted by Sense:buds Consumer Community, you are required to observe the following rules:

All surveys should be completed truthfully and honestly.

Surveys should only be completed by the individual to whom they are addressed.

The content of surveys should not be publicised or shared in any media without our prior written permission from Sense:buds Consumer Community.

Failure to comply with these rules may result in termination of your account.

Confidentiality of Studies

During studies Sense:buds Consumer Community's clients may disclose confidential information and material regarding products and/or services.

This may include, but is not limited to: concepts, advertising, ideas, text, images, audio and video. Any such information and material shall remain the sole and exclusive property of its owner. By becoming a member, you agree that you will keep any content and materials disclosed to you as part of a study in which you participate confidential. You agree not to disclose them to any third party or use the information for any purpose other than participating in the study.

You are obliged to return to us or destroy any materials relating to any project you participate in. We will inform you during the research as to the method required for material disposal (return or destroy). Where you are required to return the materials to Blue Yonder Research, we will bear the full cost and will provide appropriate means to enable you to do this.

Data Protection

We take the protection of your personal data very seriously. Sense:buds Consumer Community make every effort to ensure online data protection. Before agreeing to these terms and conditions we recommend you read our Privacy Policy.

Restriction of Liability

Blue Yonder Research make every effort to ensure the accuracy of the information published on the Sense:buds Consumer Community website and social media channels however we cannot guarantee that the information is free from inaccuracy and we cannot be held responsible for any loss or damage to an individual (save in the case of our fraud or of death or personal injury caused by our negligence in respect of which there is no limit) or company either as a direct, indirect or consequential result of acting upon information published on the website or via social media channels.

From time to time links to external, third party websites not under the direct control of Sense:buds Consumer Community may be included in the content of the Sense:buds Consumer Community website or social media channels. Sense:buds Consumer Community cannot be held responsible for any information published on third party websites. By agreeing to these terms and conditions you agree not to make any claim against Sense:buds Consumer Community or employees or representatives of the same in relation to the content of the website or social media channels operated by Sense:buds Consumer Community. This restriction of liability section applies only to the extent permitted by law.

Incentives

Survey incentives offered vary between projects, these may be in the form of a online bank transfer or digital online voucher to a specified value. Occasionally a prize draw will be conducted in lieu of individual incentives. From time to time Sense:buds Consumer Community may offer products as an incentive, Any such offer is subject to availability and stock. You will always be told what the incentive for any given project is before you take part. In some cases, no incentive will be available for completion of a particular survey.

Copyright

All information and images (the Content) published by Sense:buds Consumer Community is subject to copyright law. Copying, amending, publishing or otherwise infringing the copyright of any or all of the Content, for any use, requires the prior written permission of Sense:buds Consumer Community. Any copying, amending, distribution or publication without the aforementioned permission is prohibited.

Ineffectiveness of Terms

Should any provision of the Terms in whole or in part, be determined to be invalid, unenforceable or void for any reason, such provisions shall be severed, and the remainder of the Terms shall continue to have full force and effect.

Choice of Law and Place of Jurisdiction

These terms are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the English courts.

Waiver

The failure of Sense:buds Consumer Community to insist on or enforce any part of these terms and conditions shall not be regarded as a waiver of any of its rights under these terms and conditions.
